1. Personal Safety & Injuries
Participation in dance classes, workshops, rehearsals and other physical activities involves an inherent risk of injury.
Participants are responsible for assessing their own physical condition and must inform the instructor of any relevant physical limitations, injuries or circumstances that may affect their ability to participate safely.
Participants must follow all safety instructions, warm-up recommendations and instructions given by the instructor.
NK DANCE STUDIO, Anastasiia Kuzmenko and its instructors shall not be liable, to the maximum extent permitted by applicable law, for injuries, accidents or other damage resulting from the participant’s own actions, negligence, failure to follow instructions, improper use of equipment, or risks inherent in participating in physical activities.
This includes, to the extent legally permitted, incidents occurring while travelling to or from the class, before or after the class, or while entering or leaving the venue.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
2. Personal Belongings
Participants are solely responsible for their personal belongings, including clothing, bags, phones, money, jewellery and other valuables.
NK DANCE STUDIO and its instructors are not responsible for lost, stolen, damaged or unattended personal belongings, whether they are lost before, during or after a class, workshop, event or studio rental, except where liability cannot legally be excluded.
We strongly recommend keeping valuable belongings with you or in a secure location.
3. Studio Bookings & Cancellations
Payments made for studio bookings and studio rentals are non-refundable and non-transferable once the booking has been confirmed, except where otherwise required by applicable law or agreed in writing by NK DANCE STUDIO.
Changing the date or transferring the booking to another person is only possible with prior written approval from NK DANCE STUDIO and is not guaranteed.
If the customer does not attend the booked studio rental, the payment remains non-refundable.
4. Responsibility for the Studio & Property
The person who books and rents the studio is fully responsible for the studio and all equipment, furniture, mirrors, floors, walls, lighting, sound equipment and other property made available during the rental period.
The studio must be returned:
• in the same condition in which it was received;
• clean and tidy;
• free from damage;
• with all equipment and furniture returned to their original positions;
• without any items being removed, damaged or misused.
The renter is responsible for the behaviour of all persons they bring into the studio.
Any damage, loss, excessive cleaning, removal of equipment or other costs caused during the rental period may be charged to the person who made the booking.
The renter agrees to reimburse NK DANCE STUDIO for the reasonable costs of repairing or replacing damaged property and for any additional cleaning or other costs resulting from the renter’s use of the studio.
Where applicable, the renter may also be responsible for costs charged to NK DANCE STUDIO by the studio owner or venue as a result of damage caused during the renter’s booking.
5. Subscriptions & Unused Classes
Subscriptions and class packages are valid only for the period stated at the time of purchase.
Unused classes do not automatically carry over to the following month or subscription period.
If a participant purchases a subscription and does not attend or complete the included classes within the applicable validity period, the unused classes will expire and no refund, credit or automatic extension will be provided, except where otherwise required by applicable law.
Participants are responsible for planning their attendance within the validity period.
6. Missed Classes & Make-Up Classes
If a participant has purchased a subscription for a specific group, make-up classes may be available for certain missed classes, subject to availability and prior approval.
Make-up classes are not guaranteed and may only be taken in another suitable group, date or time approved by NK DANCE STUDIO.
A missed class does not automatically create a right to a refund, credit, extension or make-up class.
Make-up classes must be used within the applicable subscription validity period unless otherwise agreed in writing.
7. Workshops & One-Time Classes
Payments for workshops, intensives, events and one-time classes are non-refundable and non-transferable after booking, except where otherwise required by applicable law.
If a participant cannot attend, they may contact NK DANCE STUDIO to ask whether their place can be transferred to another person, but such transfer is subject to prior approval and availability and is not guaranteed.
8. Changes to Classes & Schedule
NK DANCE STUDIO reserves the right, where reasonably necessary, to change an instructor, class time, location or schedule.
In exceptional circumstances, a class may be cancelled or rescheduled. Where this occurs, NK DANCE STUDIO will provide an appropriate alternative, such as a replacement class or another reasonable solution, in accordance with applicable law.
9. Participant’s Responsibility
By participating in any class, workshop, event or studio rental, the participant confirms that they:
• understand that dance and physical activity involve risks;
• are responsible for their own safety and behaviour;
• will follow the instructor’s instructions;
• will use studio equipment responsibly;
• will immediately inform the instructor of any injury, pain or physical limitation;
• will not participate if they believe that doing so may put their health or safety at risk.
10. Acceptance of the Terms
By purchasing a subscription, class, workshop, event or studio rental, the customer confirms that they have had the opportunity to read these Terms & Conditions and agree to be bound by them.
These Terms & Conditions apply to all bookings unless otherwise agreed in writing by NK DANCE STUDIO.
Nothing in these Terms is intended to exclude or restrict any consumer rights or legal protections that cannot lawfully be excluded or restricted.
